立命館大学の加地伸行教授の正論は、まさに今の日本の問題点の原点を突いているように感じる。江戸時代・明治時代と世界に誇る精神文化圏を形成してきた日本の輝きは取り戻せるのでしょうかね。大型連休と浮かれる日本、先に待っているのは厳しさだけのように感じてしまう。内容を以下に示します。熟読ください。
新しい憲法が発布された当時、農業人口は６割以上、家族共同体も地域共同体も生きており、社会の規律や慣行も以前通りであり、新憲法がそれらを転覆させる力があろうなどとは、ほとんどの人は思ってもいなかった。
しかし、時は過ぎ六十有余年、農業人口が数パーセントに激減した今日、日本国憲法は日本の伝統を破壊し尽くしてしまった。その根源は第２４条にある。第２４条第１項はこう述べる。「婚姻は両性の合意のみに基づいて成立し」と。 この条文は個人主義の立場に立つ。「両性の合意のみ」が家族を形成するという宣言であり、その具体像が核家族である。
夫婦二人の幸せだけでいいとしてきたこの家族像には、親も見えない、子も見えない。まして親類などはむしろ煩わしいとなる。
こうした希薄な関係からか、近ごろ家族内犯罪が多発している。もちろん、昔も家族内犯罪はあった。しかし、近ごろのそれは異常だ。親の葬儀をせず、その死を隠して親の年金を受け取り続ける。育てられないと称して幼児や少年少女を虐待死に至らしめる親。
或る僧侶が引く次のような実話は、現実のすさまじさを物語って余りある。 或る夫婦は、老親の面倒をみず、親の建てた家から追い出し、庭に掘っ立て小屋を造りそこに住まわせた。老親が亡くなったあと、小屋を壊そうとすると、夫婦の子がこう言ったという。お父さんやお母さんが年とったらそこへ入ってもらうから、壊さないでほしい、と。
明治以来、日本は欧米の個人主義を模倣してきた。もっとも、昭和２０年の敗戦までは、実質は家族主義との折衷であった。
しかし、昭和２１年に制定された日本国憲法は個人主義一色であり、法律や制度から家族主義を叩き出してしまった。そして、六十有余年の間に、実質的にも家族主義は後退してしまった。
それでは、自律的な個人主義が確立されたかと言うと、それは無理だった。なぜか。
個人主義を唱える欧米人といえども、自律的個人主義を身につけるのはなかなか困難で、ともすれば勝手な利己主義者となりやすい。しかし、利己主義者とならさせない抑止力があった。それは、唯一最高絶対神の存在である。この神は人間が利己主義者となることを許さない。この抑止力によって、信仰のある欧米人は自律的個人主義者となることができたのである。一方、信仰なき者には抑止力がなく、利己主義者となる。
さて日本。日本には唯一最高絶対の神は存在せず、当然、それへの信仰はなく、抑止力もない。そのため、個人主義という思想だけを導入し教育しても、自律的個人主義者となりえず、勝手な利己主義者となってしまうのである。
現に、見よ、わが国の学校は抑止力なき個人主義を教えるため成果はなく、無惨にも利己主義者の養成機関に成り果てているではないか、小学校から大学まで。
ここで思い返してみよう。昨年の東日本大震災のとき、被災者は行方不明となった家族の名を呼び続けていた。ここなのだ、絆の最も中心となっているのは家族なのである。
この家族をつなぐ絆とは血である。家族は血でつながり、家族共同体にこそ日本人の生きる基盤があるのだ。にもかかわらず、個人が基盤と人々は言い続けてきた。なるほど自律し自立できる個人主義者ならば、それは可能。しかし、実体は勝手な利己主義者ではないか。それも金銭なき利己主義者であるから、老後は孤独な死。
家族主義は家制度を超えて、実は日本人の死生観に基づいている。すなわち、（１）祖先から子孫・一族へという生命の連続（２）子孫の慰霊により人々の記憶に残ること、この両安心感が死の不安や恐怖を鎮めるのである。
そうした古来の死生観の上に立った家族主義だからこそ、日本人は最期にはそこに依るのである。
今も微動だにしないこの死生観の上に立つ家族主義において、家族の在り方の抑止力となっているのが祖先なのである。
とすれば、２４条は、日本人の死生観に基づき、祖先を敬愛する家族共同体の姿を示すべきである。
結婚に対する価値観や意味合いも変質してしまっていますね。もちろん両者の幸せは伴わなければならないでしょうが、それ以上に結婚を通じて氏族や社会、もっと広くいえば国家・世界のためになる要素が強かったように感じますね。社会の最小単位は個人でなく家庭ですね。
佐藤一斎の言志四緑などを見ても、江戸末期の人が、こんな深い洞察をしていたことに驚かされます。そこには、明確に神仏が語られ、それに基づいた人生観が語られています。神仏に立脚した強い個人・そして神仏によって結び付けられた結婚より生じる強い家庭、その基盤の上に強い国家そして世界を再構築していくことがまさに必要でしょうね。
